By accessing or using KerrFadia ("the Platform"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Platform.
1. Who We Are
KerrFadia is a rental marketplace that connects landlords and tenants in The Gambia. We provide the tools and platform — we are not a landlord, tenant, or party to any rental agreement made through the Platform.
2. Eligibility
You must be at least 18 years old to use KerrFadia. By registering, you confirm that the information you provide is accurate and that you have the legal right to enter into agreements.
3. Landlord Responsibilities
Landlords are solely responsible for the accuracy of their listings, including photos, descriptions, prices, and availability. Listings must represent a real property that the landlord has the legal right to rent. Misleading, fraudulent, or duplicate listings are prohibited and will result in account suspension.
4. Tenant Responsibilities
Tenants are responsible for conducting their own due diligence before entering into a tenancy agreement. KerrFadia does not guarantee the condition, safety, or availability of any property. Tenants must honour booking commitments once a booking is confirmed.
5. Platform Commission
KerrFadia charges a service fee on completed bookings. Founding landlords (those who joined before 1 January 2027) pay 3% commission for their first 6 months, then 7% thereafter. Fees are deducted automatically from the payment before the balance is transferred to the landlord.
6. Payments
Payments are processed securely through Stripe. KerrFadia does not store card details. All transactions are subject to Stripe's Terms of Service. Refunds are processed according to the cancellation policy agreed at the time of booking.
7. Prohibited Activities
You may not use KerrFadia to: post false or misleading listings; harass or threaten other users; attempt to circumvent platform fees by arranging payments outside the platform; use the platform for any unlawful purpose; or attempt to gain unauthorised access to any part of the platform.
8. Intellectual Property
All content, branding, and software on KerrFadia is owned by or licensed to KerrFadia. You may not copy, reproduce, or redistribute any part of the Platform without written permission.
9. Limitation of Liability
KerrFadia is a marketplace and is not liable for disputes between landlords and tenants, property damage, personal injury, or any losses arising from use of the Platform. We provide the Platform "as is" without warranties of any kind.
10. Account Termination
We reserve the right to suspend or terminate any account at any time for violation of these Terms, fraudulent activity, or any behaviour that harms the Platform or its users.
11. Governing Law
These Terms are governed by the laws of The Gambia. Any disputes shall be subject to the jurisdiction of the courts of The Gambia.
12. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the Platform after changes constitutes acceptance of the new Terms.
